An Ordinance to Repeal Ordinance No.1973-1

WHEREAS The General Assembly of the Commonwealth of Pennsylvania adopted, and the Governor of said Commonwealth approved, under the date of January 24, 1966, P.L. 1535, Act No 573, known as the Pennsylvania Sewage Facilities Act, as subsequently amended, hereinafter referred to as “Act 537”; and

WHEREAS Act 537 prescribes that no person shall install an individual or community sewage disposal system or construct any building in which an individual or community sewage disposal system is to be installed, without first obtaining a Permit to do so; and

WHEREAS Ordinance 1973-1 was enacted by the Board of Supervisors of Franklin Township on October 2, 1973, which required residents to obtain a Permit for the construction and/or alteration of an individual or community sewage system regardless of the size of the lot or tract of land; and

WHEREAS Ordinance 2001-1 was enacted by the Board of Supervisors of Franklin Township on November 5, 2001, which also required residents to obtain a Permit for the construction and/or alteration of an individual or community sewage system pursuant to Act 537; and

WHEREAS Ordinance 2001-1 also authorized the Susquehanna County Council of Governments, hereinafter referred to as “COG”, to accept applications for and to issue Permits indicating that the site and the plans and specification of proposed systems are in compliance with the provisions of Act 537; and

WHEREAS COG is disallowing residents of Franklin Township exemptions provided for in Act 537 due to portions of Ordinance 1973-1; and

WHEREAS It is not the intention of the Board of Supervisors of Franklin Township to place additional restrictions on the construction and/or alteration of an individual or community sewage system than what is required by Act 537, nor to impede or prevent the obtaining of any exemptions provided for therein;

IT IS HEREBY ORDAINED that Ordinance 1973-1 be repealed no later than five (5) days after the enactment of this Ordinance.
